If the application is approved, it will be published for 30 working days in the organization’s Industrial Property Gazette so that interested parties can file an opposition. And if not, that body issues an office action requesting clarifications or missing documents. The industrial design must be released if the questions are correctly addressed. The application shall be considered abandoned if the criteria are not satisfied promptly.

#01 The examination on filing

The first step in the European patent granting procedure is the examination on filing. This involves checking whether all the necessary information and documentation has been provided. So that the application can be accorded a filing date.

#02 European search report

A European search report is created while the formalities investigation is being conducted, listing all the papers that are available to the Office and may be important for determining novelty and inventive steps. In addition to the description and any drawings, the search report is based on the patent claims.

#03 Publication of the application

The application is often published along with the search report. the priority date or, if priority was claimed, 18 months following the filing date. After that, applicants have six months to decide whether or not to continue with their application by asking for a substantive examination.

#04 Substantive examination

The European Patent Office investigates, following the submission of the request for examination, whether the invention and the European patent application satisfy the conditions of the European Patent Convention and whether a patent may be issued. Three examiners make up a regular examining division, one of whom stays in touch with the applicant or representative. To ensure the highest level of neutrality, the examining division as an entire decides on the application.

#05 The grant of a patent

If the examining division decides that a patent can be granted, it issues a decision to that effect. And mention of the grant is published in the European Patent Bulletin once the translations of the claims have been filed and the fee for grant and publication have been paid. Therefore, the decision to grant takes effect on the date of publication. The granted European patent is a “bundle” of individual national patents.
